Your privacy is important to us

This Privacy Policy applies to Tomorrow Man Pty Ltd (ACN 627 119 402) (trading as Tomorrow Man and/or Tomorrow Woman, respectively) (we, us, our) and explains how we collect, hold, use and disclose your personal information and comply with the requirements of applicable Australian privacy laws including the Privacy Act 1988 (Cth).

We recognise the importance of your privacy, and that you have a right to control how your personal information is collected and used. This Privacy Policy applies in respect of all personal information collected by us, including the personal information of workshop, program and event participants, and existing and prospective suppliers, contractors and employees.

1. Collection of personal information

1.1. We collect personal information from workshop, program and event participants and attendees, website users, existing and prospective suppliers, contractors and employees and other individuals who interact with our organisation for various business purposes set out in this Privacy Policy.

1.2. The types of personal information we collect about you depends on the circumstances in which that information is collected. The kinds of personal information we collect and hold includes:

  • contact details (such as your name, postal address, email address, and telephone number);
  • age, date of birth, gender and information on personal lifestyle;
  • photographs and videos of participants attending workshops, programs and other events facilitated by Tomorrow Man or Tomorrow Woman;
  • transaction, financial and billing information;
  • statistical information regarding the use of the Tomorrow Man and Tomorrow Woman websites, including website users' IP addresses, the dates and times of visits, demographics and interests;
  • business and work-related information about you which is relevant to us (e.g. your place of work, role, authority to transact with us, etc.);
  • if you work for us, personal information relevant to your role such as relevant medical conditions, emergency contact details, payroll, banking, insurance and tax information and details of your performance, skills, qualifications and other matters relating to your work;
  • if you are a prospective employee, information that you provide or we receive as part of the engagement or recruitment process (e.g. information about your professional and educational qualifications, skills and experience, the outcome of reference and background checks); and
  • other information relevant to the provision of products and/or services by or on behalf of Tomorrow Man or Tomorrow Woman.

1.3. We usually collect personal information through (as relevant):

  • registration for our products or services in-person or online, including via third party websites (for example, online ticketing platforms such as Eventbrite);
  • your participation in Tomorrow Man and Tomorrow Woman workshops, programs and other events;
  • our websites;
  • social media pages that we control;
  • receipt and processing of donations;
  • third party service providers;
  • requests to join a mailing list or to be contacted for further information about our products or services;
  • provision of participant service and support;
  • if you work for us, your provision and our generation of information about you and your activities in the course of your employment or engagement;
  • if you are a prospective employee, employment applications; and
  • responses to surveys or research conducted by us or on our behalf

1.4. Where practicable, we will collect personal information directly from you. In some cases, we may collect your information from an outsourced service provider or another third party who collects information on our behalf (including online ticketing platforms such as Eventbrite). If we receive information about you from someone else, we will take reasonable steps to ensure you are aware that we have collected personal information about you and the circumstances of the collection. In some cases your personal information may be collected by the relevant third party and will be subject to the third party's privacy policy.

1.5. You do not have to provide us with your personal information. However, if you do not provide us with the information we request, we may not be able to fulfil the applicable purposes of collection. For example, we may not be able to provide the information, product and/or service you may have requested and may not be able to handle enquiries in connection with those products and/or services, you may be ineligible to participate in workshops, programs and other events or, if you are a prospective employee, we may not be able to process and assess your job application.

1.6. In accordance with the APP 3, Tomorrow Man may only collect personal information where it is reasonably necessary for the organisation's functions or activities. Accordingly, Tomorrow Man must, if and upon request, be able to evidence to the Office of the Australian Information Commissioner (OAIC) that: (a) they have collected this information for the purposes of coaching and training; (b) such collection was reasonably necessary for the organisation's functions; and (c) the information was not otherwise used for an undisclosed purpose not addressed in either consent form.

2. Use and disclosure of personal information

2.1. We will only use and disclose your personal information in accordance with applicable privacy laws and this Privacy Policy. We may collect, hold, use and disclose your personal information for the following purposes (as relevant):

  • to facilitate the supply of our products and/or services to our participants and the participants of workshops, programs and events organised by third parties who have engaged us (including by facilitating workshops, conferences and other training and education programs or events);
  • to provide you with administrative information and updates regarding our products and services, for example, information about workshops, programs or events that you have registered to attend, websites, as well as changes to our terms, conditions and policies;
  • to complete and process your donation;
  • to work with and procure products and/or services from our suppliers and service providers;
  • to collaborate and partner with our funders and affiliated brands, including for the purposes of cross-promotion;
  • to respond to enquiries from existing or prospective participants and provide information or support in relation to our products and/or services;
  • if you are a prospective employee, to process and assess your job application;
  • if you work for us, for human resources management purposes, such as personnel management, planning and implementation of staffing and training, promotions, transfers and other career-related matters, implementation and administration of benefits, payroll administration, and verifying and enforcing compliance with our policies;
  • to undertake research and surveys and analyse statistical information and otherwise seek participant feedback for business development purposes;
  • to tailor and enhance the functionality, and to monitor and evaluate the performance and security, of our websites;
  • to conduct audit, accounting, financial and economic analysis of our business operations;
  • to protect our legal rights, investigate suspected misconduct or assist law enforcement agencies;
  • to comply with our legal and regulatory obligations; and
  • for any other purpose communicated to you at or around the time we collect your personal information.

2.2. We may also use and disclose the personal information we collect for other purposes that are permitted, required or authorised by applicable law, including:

  • the transfer of the assets and operations of our business to another party as a going concern;
  • where it is necessary to protect the rights, property or personal safety of any of our participants, any member of the public or our interests;
  • for purposes which you would reasonably expect and which are related to the primary purpose of collection of personal information; or
  • for any other purposes for which you have given your consent.

3. Who do we disclose your personal information to?

3.1. In carrying out our business, it may be necessary to share information about you with and between our affiliates, personnel and organisations that assist us to perform our business activities and functions, including those who help to provide, promote or improve our products and services.

3.2. The third parties we may disclose your personal information to include:

  • our affiliates and related bodies corporate;
  • our suppliers and service providers, including those to whom we outsource certain of our information technology functions (e.g. cloud services, website hosting, data analysis, payment processing, infrastructure provision, IT services, email delivery services, credit card processing, auditing services and other similar services);
  • our agents, supporters, funders, partners and other third party organisations who promote and publicise Tomorrow Man and Tomorrow Woman workshops, programs and events;
  • appropriate government, regulatory, judicial or law enforcement authorities;
  • professional advisers such as accountants, solicitors, business advisers and consultants; and
  • any other third parties notified to you at or around the time we collect your personal information.

4. Disclosure of information outside of Australia

4.1. We do not routinely disclose personal information overseas.

4.2. The privacy laws of those countries may not provide the same level of protection as the privacy laws of Australia. However, this does not change our commitment to safeguard your privacy and we will comply with all applicable laws relating to the cross-border disclosure of data.

5. Videos, photos and other recordings

5.1. We may film, photograph or otherwise record participants attending Tomorrow Man and Tomorrow Woman workshops and other events. The images, footage and audio and/or visual recordings we take may include footage, audio and photos of specific individuals (for example, in interview format) or may be more general in nature, capturing participants in a group setting.

5.2. Photographs, video, audio and/or other recordings will be used and disclosed for a variety of purposes notified to you, including documenting, publicising and promoting the work of Tomorrow Man and Tomorrow Woman by incorporating such content into annual reports and promotional material, as well as on our website, social media channels and in newsletters. We may share photo, video and other content with third parties including our partner, supporter and funder organisations for the purposes of cross promotion and with suppliers and service providers for production purposes.

6. Marketing

6.1. Like most businesses, marketing is important to our business' success. We therefore, from time to time, send marketing materials to current or prospective participants. We will only send you commercial electronic messages where you have consented to receive them, or as otherwise permitted by law.

6.2. If you are receiving promotional information from us and do not wish to receive this information any longer, please contact Tomorrow Man and/or Tomorrow Woman directly using the contact information set out below and ask to be removed from our mailing lists, or use the unsubscribe facilities included in our marketing communications.

7. Digital technology

7.1. Tomorrow Man and/or Tomorrow Woman and third parties may use digital technologies such as cookies, server logs, cloud service logs and web beacons in connection with our websites and other online services. Some of these technologies may operate without collecting or using any personal information. Please note that this Privacy Policy applies to our collection, use, disclosure and storage of personal information only.

8. Storage and security of your personal information

8.1. We hold your personal information both electronically and in paper form. In doing so, we take reasonable steps to protect your personal information from misuse, interference and loss, and unauthorised access, modification and disclosure.

8.2. Unless the law otherwise requires, when we no longer need to use your information, we will take steps to properly de-identify or destroy it.

9. How to access and correct your personal information

9.1. If at any time you want to know exactly what personal information we hold about you, or to correct that information, you are welcome to request access to or correction of your information by contacting us using the contact information set out below.

9.2. We will consider all requests to access and correct personal information within a reasonable time. Unless there are reasons why we cannot provide you with access to your personal information (e.g. for legal reasons), the personal information we hold about you will be made available to you or corrected within a reasonable time after we receive your request.

10.2. We will endeavour to respond to your enquiry or complaint within a reasonable period. If we fail to respond to a complaint within a reasonable time or if you are dissatisfied with our response, you may submit a complaint to the Office of the Australian Information Commissioner at www.oaic.gov.au.

11. Future changes

11.1. We may amend, revise or update this Privacy Policy from time to time, in our sole discretion. The most current version is located on each of the Tomorrow Man and Tomorrow Woman websites, so we encourage you to check these websites periodically for any updates.

11.2. If at any point we decide to use personal information in a manner materially different from that stated at the time it was collected, we will notify you by email or via a prominent notice on our website, and where necessary we will seek your prior consent.
